What is the IRS capital gains tax rate?
The capital gains tax rate is 0%, 15% or 20% on most assets held for longer than a year. Capital gains taxes on assets held for a year or less correspond to ordinary income tax brackets: 10%, 12%, 22%, 24%, 32%, 35% or 37%. Capital gains taxes apply to the sale of capital assets for profit.
Capital gains taxes are levied on earnings made from the sale of assets like stocks or real estate. Based on the holding term and the taxpayer's income level, the tax is computed using the difference between the asset's sale price and its acquisition price, and it is subject to different rates.
Long-term capital gains tax rates for the 2024 tax year
For the 2024 tax year, individual filers won't pay any capital gains tax if their total taxable income is $47,025 or less. The rate jumps to 15 percent on capital gains, if their income is $47,026 to $518,900. Above that income level the rate climbs to 20 percent.
Capital gains tax rates
A capital gains rate of 0% applies if your taxable income is less than or equal to: $44,625 for single and married filing separately; $89,250 for married filing jointly and qualifying surviving spouse; and. $59,750 for head of household.
Determine your realized amount. This is the sale price minus any commissions or fees paid. Subtract your basis (what you paid) from the realized amount (how much you sold it for) to determine the difference. If you sold your assets for more than you paid, you have a capital gain.
This means right now, the law doesn't allow for any exemptions based on your age. Whether you're 65 or 95, seniors must pay capital gains tax where it's due. This can be on the sale of real estate or other investments that have increased in value over their original purchase price, which is known as the 'tax basis'.

Is capital gains tax federal or state?
Capital gains are taxable at both the federal level and the state level. At the federal level, capital gains are taxed at a lower rate than personal income.
Long-term capital gains, on the other hand, are profits you earn on assets you've held for more than one year. The IRS doesn't tax these gains the same as your other taxable income. Instead, it looks at your taxable income for the year and your filing status to determine if your tax rate is 0%, 15%, or 20%.
Current tax law does not allow you to take a capital gains tax break based on age. In the past, the IRS granted people over the age of 55 a tax exemption for home sales. However, this exclusion was eliminated in 1997 in favor of the expanded exemption for all homeowners.
You might be able to defer capital gains by buying another home. As long as you sell your first investment property and apply your profits to the purchase of a new investment property within 180 days, you can defer taxes. You might have to place your funds in an escrow account to qualify.
If you sell your primary residence, you qualify for an exemption from capital gains up to $250,000 for an individual or $500,000 for a couple filing jointly. In the past, this exemption was restricted to people who bought another house or reached a threshold age, but that's no longer the case.
If you owned and lived in the home for a total of two of the five years before the sale, then up to $250,000 of profit is tax-free (or up to $500,000 if you are married and file a joint return). If your profit exceeds the $250,000 or $500,000 limit, the excess is typically reported as a capital gain on Schedule D.
You can use your home sale proceeds to plan for retirement by investing those proceeds in other money-maximizing investments. Or, you can put the money into an annuity or permanent life insurance policy with a cash value to supplement your retirement income.
You may take an exclusion if you owned and used the home for at least 2 out of 5 years. In addition, you may only have one home at a time.
Heirs generally do not take over a deceased person's original cost basis, so you would not realize a significant capital gain based on your relative's original purchase price. However, any price appreciation after the date of death could result in a capital gain.
Seniors can earn more income than younger workers before submitting a tax return. People age 65 and older can earn a gross income of up to $15,700 before they are required to file a 2023 tax return, which is $1,850 more than younger workers.
What excludes you from paying capital gains tax?
You can sell your primary residence and avoid paying capital gains taxes on the first $250,000 of your profits if your tax-filing status is single, and up to $500,000 if married and filing jointly. The exemption is only available once every two years.
Single tax filers can benefit from the zero percent capital gains rate if they have an income below $47,025 in 2024. Most single people with investments will fall into the 15% capital gains rate, which applies to incomes between $47,026 and $518,900.
If you inherit property or assets, as opposed to cash, you generally don't owe taxes until you sell those assets. These capital gains taxes are then calculated using what's known as a stepped-up cost basis. This means that you pay taxes only on appreciation that occurs after you inherit the property.
Double taxation occurs when a corporation pays taxes on its profits and then its shareholders pay personal taxes on dividends or capital gains received from the corporation. A financial advisor can answer questions about double taxation and help optimize your financial plan to lower your tax liability.
But, capital gains will increase your adjusted gross income (AGI), and this can cause you to lose eligibility to contribute to an IRA or a Roth IRA, and you could be phased out of itemized deductions and some tax credits.
